If Colorado legalized marijuana, would our state police consider it legal?

or would they

follow fed laws and still write you up on possession charges??

Say in Nov. it passes can I then smoke a joint up town or could the local sheriff arrest me?

  1. federal law overrides state law .  


  2. State agents cannot enforce federal law, and vice versa.  

    If the state legalizes something, the state police cannot do anything about it.  This is the current situation in California.  That is why the DEA sends agents to states that have legalized it.  

    Don't listen to this "federal law overrides state law" stuff.  It means nothing in this case.

  3. Your state would be in violation of Federal law which outlaws marijuana. If your state legalized the pot there would be arrests from the Feds on citizens and state officials besides threatening to hold back Federal money which amounts to big bucks from the state. In California Feds have raided some of the so called marijuana clinics and arrested some doctors who were prescribing the dope. The FDA will not allow any drug that is induced by smoking since it goes against health guidelines. Their website will tell you this.

  4. State police are just that... State Police. They would have to follow all laws that are written in the state. No questions about it. I'm pretty sure that the decision falls into the Federal Governments court, but hey, who knows.

  5. Even if they legalized Marijuana, I wouldn't push it by doing it in public.

    It's one thing to have peace of mind knowing that you can do it indoors or in your back yard privately and not have to worry about getting busted, but marijuana is still taboo enough that a lot of people, myself included, wouldn't want a bunch of people blazing downtown.

    It's like alcohol. Yeah, it's legal and you can enjoy it at a restaurant or on your deck, but you can't just stroll down the street pounding back a Jack Daniel's.
