Question:

If I'm at the poverty level i get halve ssi and half my X's Social Security Can I be sued? I'll get $303 ?

from my x and that starts in June of 09 ! But as of now I'm getting 683 ssi . So Social will pay the remaining to make the $303 from my x to make it 683. Is that still poverty level?

  1. The Social Security cannot be touched.  Federal law protects it.  That doesn't mean a local judge won't ignore Federal law.  The other money is fair game, if they can get at it, and like SSI it is nearly impossible to reach unless you put it into a bank.  Being at the poverty line doesn't matter but the source of funds does matter.  You have a dispute with a dealership, but you didn't handle it correctly either.  You cannot usually just take a car back.  You may want to sue them for delivering a car to you that wasn't merchantable.  That would clear it off your credit report if you won.  Cars are a special topic under the law and each stay has its own "lemon laws," which may or may not apply.  You may also call your state's Attorney General.


  2. I wouldn't worry.  As you see, YES you can be sued.  ANYone can be sued for ANYthing at ANYtime.  

    The auto dealership is using this as a "negotiating" tactic.  From what you say it is probably small claims court which is very cheap and easy to file for, so they figure "why not?" and you get the summons, get scared and run in their with the money and they are happy.  Remember, civil lawsuits are nothing but another way of negotiating, that is ALL.  That is why 95% of them get settled or dropped.

    You are basically "judgement proof".  The auto dealer can sue you and will probably win, but so what?  They get a piece of paper saying you owe money to them.  They will probably never try to collect on the judgement, that is a whole 'nother process and is more expensive than the money you owe.

    If I were you, I would go to court, tell your story and see wha happens.  If you DO NOT go, you WILL lose.  If you go, maybe the judge will dismiss the case.  Small claims court is less about the law and more about the opinion of the judge.  Wear a short skirt, show some b***s and hope for a dirty old man judge.  :)))
