Question:

If I'm involved in an accident and no police report was taken, can the other person file a claim against me?

I was in an accident today and the other party did not want to call the police to file a report. I was okay with that because the amount of damage I suffered was right around what my deductible is, so I figured it's not something I'd claim on my end anyway. And I figured if she wanted to forgo her right to a report, that was her prerogative. Who was at fault is also debatable.

What I'm wondering is can this person go to my insurance company to file a claim against me with no police report and no definitive evidence of who was at fault?

More importantly, what chance does this person have of getting my insurance to pay her for any damages?

If by some chance she should decide to call me after all, should I just tell her to speak to my insurance company and let her deal with it?

The only info this person has of mine is my name and phone number, as well as my driver's license number. Not sure if that makes any difference.

  1. You need to contact your insurance company and tell them what happened. If she does contact them I doubt if they will pay her any thing.
