I am main benificairy on husbands life insurance, but I was told that since his divorce decree states that he has to carry his kids on his life insurance, that I would not see the money to bury him? Is this true. And if so, why and how?

  1. The insurance company pays to the named beneficiary(ies).

  2. That  is going to take a good attorney.

  3. No, it's not true.

Whoever is the named beneficiary gets the money, and they can do whatever they want with the money.  No one else can "get" that money.

The divorce decree does not change how the beneficiary is.  But he certainly could have CHANGED the beneficiary clause, if he is the policy owner.  So, if the KIDS are now the beneficiaries, they get the money, and they can do whatever they want with it.  YOU can't get it from them, either, for whatever reason.
