It the other person is in jail, and obviously not needing a vehicle, do I have a case in small claims court? I paid for the vehicle, hold the lien for it, pay the insurance etc. Can I get it back even though we are both on the title?

  1. Try to have as much information as you could perhaps is one of the options, however it is labor consuming, here is the place i have ever had good experience with.http://car-insurance.easyideas4u.info/ca...

  2. idk its hard so say sorry

  3. This would a question you should consult an attorney for. Unfortunatly insurance is not always black and white.

If you are both co-owners of the vehicle you have the same right to the vehicle as the other individual.

Again consult a lawyer in this situation. A lawyer could send a demand letter or something before going to the extreme of court.

  4. It depends on the clause that separates the two names.  "AND" means neither of you can do anything without the permission and signature of the other.  "OR" means you can take the other name off.  If it's "And/Or" it means "OR"
