If I drive a 7.5 tonne truck less than 10 days a year do I need to abide by EU driving hours rules?

I drive to 6 race meetings a year for my employer, someone else will drive back. I need to know whether I am allowed to work at the meeting or do I have to take an enforced break as per the EU driving hours.

  2. Hi there,

    I'm afraid you do have to abide by the rules, yes. In EU legislation there are no concessions for 'occasional' drivers such as yourself. So, any day you drive that 7.5T vehicle, you are driving under EU Drivers' Hour and Tachograph Legislation 561/2006.

    So basically the rules that apply to you are as follows:

    ~you will need a minumum of 45m break after no more than 4h30m aggregate driving (can be taken as one 45m break or split into two breaks of 15m minimum followed by 30m minimum, and has to be in that order)

    ~ your shift cannot exceed 15h from beginning to end

    ~you must take at least 9h in the 24h period that started when your shift commenced

    ~your daily driving limit is 9h but this may be extended to 10h twice in any fixed week

    Incidentally if you drive on only 10 occsions in a year then, according to the Road Transport Directive, you are classed as an 'occasional mobile worker'.

    WHEN YOU GET OFF PUBLIC HIGH WAY DO YOU PARK UP STRAIGHT AWAY, IF SO AND YOU ARE NOT DRIVING THE TRUCK AGAIN STOP THE TACHO

    AS LONG AS YOU ARE NOT DRIVING ON HIGH WAY AGAIN NO NEED TO TAKE ENFORCED BREAK

    THE ENFORCED BREAK IS BEFORE YOU CARRY ON DRIVING
