If I get a k1 visa, can I still come visit to the us during the whole process?

While I'm wating for my k1 visa, and it's pending can I still visit my fiance in the us? he's the one signing the petition?

  1. NO!!!!! not legally.. with a k1 pending they will deny you any other visa on the spot.. just an idea but you may try coming to usa, then apply for k1 and adjustment of status... it IS perfectly legal BUT they (immigration/uscis) get very difficult if they think you are playing the system so i can't guarantee that is advisable.. one thing for sure is absolutely 100% of the time be totally honest and open with them and if you are genuinne and not up to bad things then its all ok, although process can be super slow.. also just fyi, the k1 is a one time entry visa, meaning once you enter you will NOT be able to leave and re-enter on k1 visa... only way you can leave and re-enter is on different visa or after becoming "permenant resident" i.e. green card


  2. Hi, I came over to the US whilst my K1 Visa was pending.  I called USCIS and asked them - they told me that as long as I took evidence with me that I was planning to return after my visit, it would be ok.  

    The only time it will become a problem is that if your Visa is issued whilst you are in the US on another visa (waiver) that is when it could be denied.  If you have plenty of time between your application and your medical and interview, you should be ok.

    I took a letter from my employer stating that I was due back at work on a certain day and took bank statements with me etc.

    Once you have your K1 visa that is your only entry into the US and you cannot leave until you have your Green Card.

  3. No you have to remain in your country and be interviewed at your local consulate. If you try and enter on a visitor visa you could damage your chances on the K1

  4. Well, it's legally possible, but practically it may be difficult. Legally, you have to establish your intent that you will return after a short stay on the tourist visa. If you can convince the interviewing officer that you aren't simply tired of waiting for the K-1 to be processed and you're just going over for a short stay, you can be issued the visa. However, convincing the interviewing officer won't be easy. Plus, you have to convince the CBP airport immigration officer as well, when you arrive. If you do apply, you need to be completely truthful about your K1 application, or you may risk your eligibility for that as well.

    But, it is at least possible.
