Question:

If I get permission to have tinted windows by the state will I be able to get out of my ticket?

I recently just got pulled over for having front tinted windows in my homestate of Illinois. I have been pulled over before for having them and I told the cop that I was sensitive to the sun and easily got migraine headaches and he told me that it didnt matter and gave me a $20 ticket. It was only 20 bucks so I payed it and kept the tints. Last week I got pulled over again and I told the cop that I got migraines from the sun and he once again didnt care and gave me a ticket saying that I have to appear in court with a picture showing that I got my tints removed. I just recently found out though that you can get a special window tinting certificate from the secretary of state if you go to your doctor and let them know that you need tints such as in my case since I get migraines. So I plan on going to the doctor and hopefully he will sign my certificate that I can show to the judge. So do you think the judge should let me go then without any fines if I have that certificate?

    That is the most ridiculous thing I have ever heard.

    Don't believe everything your friends tell you.

    You need to show me proof that the secretary of your state would do such a thing, what would they of all people have to do with that?


  2. Get your checkbook ready. Whoever told you that was dreaming. It is not going to happen. I don't think it would be in your best interest to tell a judge you have a condition that could affect your driving. He may decide to end that problem for you.

  3. If you didn't have the permission to have the overly tinted windows PRIOR to when you got the ticket, you can't use the certificate now.  The only way you can get out of this ticket is if you had the certificate BEFORE you got your ticket.

  4. If you have the proper certification from the state, the Judge should be satisifed with that.  But he may still fine you or at least assess you court costs.  

  5. It would be the first ever certificate I have ever heard of for something like this.  I agree with the physican's take on this that regardless, you would be a danger on the road.  I would have taken it a step further and asked the dept of motor vehicles investigate it further.

    You are not able to tint your windshield so what is it that you do when you are driving in the morning or afternoon when the sun is facing you?  

    A judge will likely not rule in your favor stating that you did not possess the certificate prior to the offence.  They may force you to stop driving just based on my earlier senario.  

    If I were you I would simply consider alternative means of transportation if you are THAT sensitive to sunlight.  Regardless of what certificate you may get, you will be pulled over for it consistently.

    As a physician, if you came to me with this story I would deem you unsafe to operate a motor vehicle and report you to the department of public safety.

    If you get disabling migraines that easily you have no right to operate a vehicle and possibly be a danger to yourself or other drivers.
