If I had a non alcoholic brew (beer) in the car while I am driving...

...and got stopped by a cop. Would I be charged with an open container? Most non alcoholic brews have a .5 alcohol content in them. But, some cough medicines have more than that. Does anyone know?

  1. Call your local police department and ask them.  It won't hurt and could save you an open container charge.

    If you got to be 21 to buy the non alcaholic beers then yes they will DUI you, if not the n probbably not.

    Also cough sysrup has alcahol in it but so tiny its negligable and if you do drink enough to get a buzz it isnt from alcahol, its from DXM

    and if you DID drink it to get a buzz thats another law

    So N/A beer is a dui

    and tussin is a charge of/ improper use of a otc controlled substance, driving under influence of drugs, and possession of DXM (in you system) if it was used to get high

  3. No. People are overthinking this question.

  4. Technically the answer would be yes but the real answer would be no. You could be cited for anything including running a red light for the open container but what would happen with that in court.

    I doubt being cited for an open container of a NA beer would impress the DA or the court and likely it would get tossed.
