If I have HOA coverage with State Farm do I have the right as an owner within the HOA to file a claim?

I was assessed $66k for bad construction. Why was there not a claim filed and instead all owners were assessed. This has had huge financial implications for me...now the HOA is dinging me at 12% a month for my outstanding debt still owing of over 27K...HELP!!!!

  1. Typically the owner of the HOA policy is the HOA itself.  The HOA has a charter with a governing body and an authorized representative.  That Rep. is the persons who could file claims through the HOA policy.  I'm guessing the governing body of the HOA looked at all options for paying for the bad construction and chose assessment. Has no one explained the reasoning behind the decision to you?

    That said, poor workmanship is not a valid reason for filing a claim.

    Unless damage is done by a covered risk, you're not getting insurance coverage.
