I have a Schengen visa issued by the spanish embassy but I don't want to go to Spain anymore. Can I fly to Italy instead? If so, will they penalise me the next time I apply?

  1. You can be stopped yes, because it contradicts the original reason that the visa was issued was for entry into the Schengen Zone via Spain. If you enter Italy, it might raise red flags. Therefore, as a safety precaution I would call both the Spanish and Italian embassies (or consulates). First call the Spanish embassy/consulate where your visa was issued. You should have the visa number on hand and inform them in a change of your travel plans. Next call, the Italian embassy/consulate closest to your home. This way they can answer any questions you might have after contacting the Spanish embassy/consulate.

  2. You are required to apply for a Schengen visa at the foreign mission of the country in which you plan to spend the most time, or through which you plan to make entry into the Schengen zone.  This is to prevent visa "shopping" at embassies that might be considered more lenient in handing out visas, even though you have no intention of visiting that country.

Can you be stopped at the border and turned back?  Yes.  Will it happen?  That depends a lot on you, how you present yourself, and your circumstances.  If the prerequisites for entry or transit no longer apply, you may be refused entry by the border authorities even though you posses a valid visa.
