Question:

If I hit a car and the driver is w/out insurance, and there is no police report, am i liable to pay damages?

Got into an accident w/someone at a an intersection w/a flashing yellow and flashing red. I had the flashing red, stopped, looked, no one came and attempted to go. Did not even get to the middle of the intersection before a car sped from the yellow flashing. Hit me. I did not want to get insurance involved. He got all my information, and when it came time to get his all he gave me was his name. He said he didnt have a number. We were supposed to meet the next day to get parts for his car at a junk yard and he never called. waited a week after then called and said he wanted 500 for labor!! His uncle is doing the work. There was no police report however, and nothing to really state who was at fault. Am i responsible to pay for his damages?

  2. The police will not become involved, and even if they responded to the scene of the accident, they are not the ones who determine liability.  The insurance company is.  

    You are getting yourself in deep.  I suggest that you report the claim to your insurance company, let them assess liability, and pay the other person what they feel is reasonable.  FL is a Pure Comparative state.  The other person could be 99% at fault for the accident and still recover 1% of their damages.

    This guy could turn around and file an injury claim down the road.   If you do not report the loss to your insurance company in a timely manner, they could deny coverage altogether.  You don't want that.  

    I have know idea how much your rates will increase, and they may not at all if you have "first time accident forgiveness" on your policy.  

    The fact that he may not have had insurance does not matter.  FL is not a No Pay, No Play state.

  3. file a police report and call your insurance company.

    they will figure out how to proceed, it may not be determined to be entirely your fault.

    if he sues, they will cover you.

  4. You should have gotten all his information including his license and plate number, regardless of who may or may not have been at fault. If he doesn't want police and insurance involved he must have a reason.....as in suspended license, police record, etc.....

    I would file a police report even if it is after the fact and contact my insurance. I would not hand over cash.
