If I hit an unlicensed driver is my insurance required to pay for his car?

My friend got into an accident with an unlicensed driver and when the cops showed up they said no one could be determined to be at fault. They said the insurance companies could duke it out. If my friend is found to be at fault, is her insurance required to pay to fix the car of the unlicensed driver?

I can't believe that the unlicensed driver was not at fault.. it goes first or worst.. if there is no one that is clearly at fault it is the unlicensed driver who becomes at fault simply by being on the road when he is not suppose to.  If they do not have a license then they probably don't have insurance.. in that case your friend best have uninsured motorist on the policy.

I had a similar situation a couple fo years ago so things might have changed since then.  I was found to be at fault in the accident (because of a stupid state law, if you hit a car in the rear it is automatically your fault, even if they cut you off and slam on their brakes), the other person was driving a car with no license and no insurance but because the cops deemed me at fault my insurance company had to pay and after that my insurance rates went through the roof...it is unfair especially since the unlicensed driver isn't even suppose to be on the road.

  5. yes, the driver should get a ticket for drving without a license, but if your friend is at fault, then she is responsible for the damage she cause to the other persons car.

The insurance company will complete the investigation and assess liability on each party.  It does not matter that the other party was not licensed.  It does not make that person automatically at-fault for the accident.  People run red lights, speed, field to yield the right of way, all of which are "illegal" acts.  If you run a red light and struck an unlicensed driver, you are still at fault, because you were negligent/liable.  Stupid to drive a car without being licensed, but that does not bar you from recovery if you were not at fault for an accident.

  7. If  NO one is at fault then no but be prepared for the NLD to file against your insurance anyway and hear about it for years to come....Those kind of people seem to like to keep lawsuits going

Generally, no, but laws in individual states vary.  If the driver was driving unlicensed, s/he was in the process of an illegal act.  They are not rewarded for that.  If, however, the unlicensed driver stole the car from a licensed driver, then the insurance company may have to pay.  Most unlicensed drivers are, however, driving their own or their parent's vehicle.
