If I killed someone should I go to jail?

If the person I killed was about to kill me?

If I was sleepwalking/not in my normal state of mind?

    3. Im not sure about this one. Is there any way to prove that you were sleepwalking? If you were out of your mind you would probably go to an asylum like Ed Gein..

  3. First one, its ok. You stopped a greater tragedy. Liberal nuts will disagree.

    Second, self defense. Again ok. Liberal nuts will say NO! You should have called the police and let them find your dead body rather than protect your own liberty and freedom as protected by the 2nd amendment of the Constitution.

    Third, enjoy the cell. Bye bye. Again liberals would say, NO! He/she couldn't help it they deserve a second chance, and a third, and a fourth.

    Fourth, burn in he@ll. Enjoy the chair, or the needle or whatever. Again liberals would say NO! They don't deserve to die just because they took someone's freedom and life away.

  7. I do agree with the frist answer. but the most important question is why do you want to know. did this not dawn on anyone?

  9. Three is really the only controversial one.  (One and two are all in the details, I suppose.)

    I'm not sure about the U.S., but we had a sleepwalking murder case in Canada some fifteen years ago - the guy drove about 23 km to his in-laws' place and quite brutally murdered them.  He successfully defended himself on the basis that he was asleep at the time.  Seems factually unlikely, but legally quite sound.

  10. 1. Depends on the law in your state...some states include neighbors, family, and property under the self defense laws.

    2. Self Defense...if you could prove it you'd get off.

    3. This has been used as a defense both successfully and unsuccessfully...it really depends on the jury.

    4. You would go to jail for first degree murder.

    In any case, if you kill anyone, you go to jail until they can determine if you deserve to be sent to prison or not.

  11. Well you might be convicted for 2.  And you would defiantly be convicted 4.  And many would regard you as a hero for 1.

    But their would be a lot of controversy over number 3.  "Was he really asleep?, Murder is murder., etc..".

    I would convict you for 4 and I would hold a trial for 2 and 3.  And I would erect a statue in your honor for 1.  

    But usually, no matter what the circumstances, you would go to jail because, "Murder is Murder."

  12. If you want  a one-word answer, it will necessarily be incomplete to the point of being wrong.  If you want to learn about defenses to murder and about the mental states that make a homicide a murder, go to a law library at a law school and read a few dozen books on the subject.
