If I paid my rent 18 days late and got a 3 day pay or quit notice 10 days ago will I still get evicted??

Will I still be evicted if got notice but payed it late but in the month it was due???How long after the late day do you really have to get it in? Will they even except my rent 18 days late?

  1. Yes, you will get evicted. Your rent was due on the first. You usually have very little grace period on rent. If your contact says due on the first, you must pay. Read your contract - it outlines the terms of your payments. They don't have to accept your late rent payment.


  2. Whether or not you are actually evicted at this stage depends on your landlord. If you plead, they might cease the eviction process, but don't bet on it.

    Leases usually specify a grace period of a few days, but you're expected to pay your rent on the 1st day of each month. The same goes with mortgage payments.

    They will accept your late rent payment because you owe it for the current month. If you don't pay it, they'll lose money, and they don't like doing that.

  3. If your rent is accepted the answer is NO. If you get your check back they are going to Court. The Court will rule in their favor assuming they timely returned your check.

    It can take 30 to 45 days to complete an eviction in Court and obtain a date for the sheriff to arrive to remove you....

  4. Rent is not "sometime this month" but on the first, unless specified in your lease to be a differant day.

    Some states have a 5 day grace period, but none 18.

    Personally I would take the rent unless you are regularly a PIA, then I would take this opportunity to get you out of my house.

    You will not know if you landlord will accept the rent until you ask him, there is no way for us to know what they will or will not accept.

  5. It depends on what you lease says. If they say rent must be paid by 15th and you paid it on the 18th and they say that you can/will be evicted if you do not pay by the 15th they have that right.

    Now depending on how good a tenant you have been and how many open units are available in the area you may not. Pay the bills first. Party second.

  6. In my state, if rent is not paid within the 3 day notice period, I can still accept the rent AND evict you. I've done it.

    Each state has different laws regarding whether accepting a payment stops the eviction process. Check your state's eviction laws

    You had until the third day after the receiving the notice to pay.

    If they refuse your rent, you are getting evicted.
