  1. Depends on your State....

    Is it a "Right to Work" State?

    The person KNEW that the job had certain hazards when they TOOK the job.....

    Wouldn't hurt to have a written agreement with the person you hire that they KNOW that there is some hazard and that they assume all responsibility and hold you harmless.

    Not to be taken as legal advice but that's what I would do!


  2. No, the homeowners insurance didn't hire them, and doesn't own the property.  The PROPERTY OWNER, or YOU, hired them, and YOU would be liable for the fall.

    Depending on how the workers comp laws in your state are written, you could be on the hook for medical payments and lost wages.  Your homeowners insurance policy may or may not cover some or all of it - it's going to depend on your policy, and your state laws.  But whether or not your homeowners covers it, YOU are still the liable party - depending on your state laws for workers comp.  

    You really need to discuss this with your agent.

  3. Probable since the fall happened on your property.  Just like if you get hurt at work & it's your fault, the company still has to pay for it.
