If I taze someone approaching me what evidance will I need that it was self defense in court?

  1. You will have to prove that you were afraid for your safety.  Did the other person have a weapon, as well?


  2. That you were in imminent danger of bodily injury, and there was no escape. Imagining or figuring he was going to kick your butt doesn't count. Didn't want to run away? Your choice, but that doesn't make it self defense. Anywhere but at your home, you're pretty much bound to try retreat first.

    The South Park defense, "He was coming right at me!", doesn't work.

    Hint: If you try to develop and argue a self-defense defense by yourself, you will lose to the prosecutor who is a real lawyer.

  3. A few eye witnesses.

  4. Just like anything else.  You'd have to prove you were in danger.  He said threatening things...and/or he had a weapon himself or he was bigger/stronger than you, and he was coming toward you.

    Would a "reasonable person" find themselves threatened in a similar situation?
