If I submit a W-9 form to companies that are interested in hiring me as a subcontractor, can I used my social security number or must I apply for a tax id number? I've already set up an LLC, but I haven't done anything beyond that.

  1. If you are an individual, then you can use your SSN.

If LLC is a sole proprietor firm, you can use tax ID of LLC. The LLC must pay franchise tax every year even if it is not operating.

  2. It's up to you. I used a tax id number when I did contract work because I didn't want other companies to have access to my private social security number.  Identity theft hadn't yet become national news, but my friend already had been a victim of it.  Some people use a tax id number instead of social security to separate their business from their personal, as in the case of a sole proprietorship.

  3. You don't need an EIN unless you incorporate or hire employes.  You can use your SSN
