Question:

If I was arrested, but not convicted of theft, will it be on my record?

So, I made an extremely stupid mistake and got arrested for shoplifting in Oregon, but when I went to court I was told to take a theft class and do some community service and that would take care of things. You think I would be responsible and know exactly how it worked and if it's on my record, but I don't. I was recently turned down when I tried to open a savings account. Is this why? Please help, your answers are greatly appreciated.

  1. Yes it is shown on your record, but is not counted as a conviction.

      


  2. Running you through NCIC would show that you were arrested. If you want it off your record, you would have to request that the arrest be expunged.

Yes....  The simple answer is that a RAP sheet, which many people don't know is short for Record of Arrests and Prosecution.  I have ran hundreds, maybe thousands of people, where their arrests show up but no conviction information is given...  So, usually an arrest, regardless of the outcome, will show on your RAP sheet.

  4. It is in my county. Any arrest would show on the County's local record databse.
