Question:

If I was arrested a week ago and not yet charged for the crime.Would it show up on a background check?

This is the first time I have ever been in trouble.I do not know the system that great.I applied for a job today.They are running a criminal background check.I have heard so many answers from so many people.I have not been convicted of the crime.I am waiting for my court date in a couple of months.

  1. As a professional in the background screening industry, the arrest will most likely not show up on the background check.  Unless, it has been assigned a case number by the court.  If the court has a case number, then it is possible for the arrest to be shown.  This is of course, only if the background screening company conducts a proper search, by using the applicants residential history and searching each city and county court for felony and misdemeanor convictions.  I say convictions, however, a pending case is legal to disseminate to the employer as well.


  2. Don't sweat it.No it wouldn't and you won't be lying when you check the box that you have never been convicted of a felony.Chill out and try to stay out of trouble.Good luck.

  4. they might be able to find out you were arrested. you are going to need the day off for court anyway.

  5. It actually dosnt show up on your background check until the case is close and you are found guilty, "inocent until proven guilty"

You're ok!  Unless there is a final disposition and you have been convited and sentence in a Court of Law, it will not appear on your background check.  Also be advised that Most companies how do background checks use 3rd party on line services that DO NOT provide complete information.  I'm working on a project right now testing various (LARGE) background check companies, running individuals who we know have extensive criminal records in several states and federal charges and most are coming back with "NO RECORD FOUND".

    So, I wouldn't worry too much about the background check.
