having massage therapists do demonstrations and I got badly injured by the massage therapist, who is responsible and to be held libel for the injury and costs involved? By the way, the massage therapist quit working at the spa soon after this incident.I went to the spa and they just brushed me off. I am in pain and want to know what my rights are here so that I can deal with it from an informed position. Thank You

  1. You must get yourself a lawyer.

    You could sue either the company or the employee but both can be problematic.

    The employee probably has no assets worth talking about, but a company will do their best to put the blame on the employee and try to say they are not liable (as you've seen).

    You will need confirmation from a doctor, preferably from soon after the incident. If you didn't see a doctor soon after, you will have virtually no chance of winning.


  2. The massage therapist, the spa, the fair's organizers, and/or the owner of the land where the fair took place may all be liable.  It depends upon the laws of the jurisdiction where the fair took place.  Consult a local personal injury attorney.  You can find one at the link below.

  3. The fair only has to make sure that the spa has a proper license to run their business, etc.  SO, having said that, the individual who performed the massage that allegedly injured you and the business that employed them would be the ones to go after.  The spa must make sure that their employees are properly trained and licenses upon hiring them, which can ultimately make them liable for alleged injuries as a result.
