If McCain secures the presidency, do you think he will make an attempt to overturn Roe vs. Wade?

In my opinion, I don't think pro-choice Americans would stand for it. I believe that there would major repercussions and tons of protests and disdain from our citizens...

But he could have the cajones to it...

My question is, do you feel that he would make an attempt to overturn Roe vs. Wade? If you think he would, what do you think would happen in this country...could it be done?

  1. This is something that should have been at the discretion of each individual state. The case could go back to the Supreme Court, and it is very slowly gathering momentum to do this very thing. McCain, if elected, would not push to overturn Roe vs Wade. He could not do it anyway.

    Bottom line is this... the Republican Party has gotten so much mileage out of this single issue that they are not about to give it away by actually delivering to their constituents what they have been asking for.

    Think about it, the only thing tying the Evangelical's to the Republican's is this issue.  If they didn't maintain the abortion issue the Republican's are simply bribe-taking, corrupt, undereducated croniests who have far to many member who enjoy g*y liasons.  Not that there are fewer corrupt Democrats necessarily but it sure seems more Republicans get caught... and at least Democrats are okay with being "out" if that is what the person is... Republicans just push the Ted Haggards, Mark Foley's (a true sicko), and Larry Craig's in their party deeper into the closet.

    In short the Republican Party is so morally corrupt it is laughable that those who consider themselves "religious" feel obligated to vote that way.  The reason.... just the abortion issue.

    So over the 35 years since Roe there have been 24 years with a Republican in the White House and numerous Republican Congress'.... and how many times has Roe been seriously challenged by new legislation??

    That's right.... they aren't giving away their wedge issue, not under McCain not ever.  I wonder how many more decades it will take before Pro-Lifers actually realize they are simply political pawns.  They are really pretty effective because they are so vocal... but the issue hasn't been addressed in 35 years and it isn't going to get addressed under McCain either.

    Making the attempt is different than accomplishing it.  He'd have to change at least a few seats on the Supreme Court, and then someone would have to challenge R v W in a lower court, and the high court would have to hear the case.

    I think it would be tough to overturn it.  The R v W decision did not allow abortions, it simply said that the Federal Government did not have the power to make a Federal Law banning it.  The states took it from there.  If the court decided this in the 1970s, it might very easily decide that again, barring a Constitutional amendment.

    I think the country would react by protests, demonstrations and one-note candidates would run for every office in the land.  So no, I don't think it would be any worse than it has been in the late 1980s, when the issue took a fever-pitch.

  5. I wouldn't doubt it!  And unfortunately, it seems that they majority of the people who would be able to influence such a decision, are also rather conservative- so he'd probably get away with it!

    Yeah, he can't do it by himself, but you bet your @ss he'll do what he can to see that it's done!

  6. He would have to appoint more conservative judges to the supreme court first. Then the case would have to reach the supreme court. I think it should go back to the supreme court because there are too many women out there using abortion as a form of birth control. It should only be used in certain circumstances, such as rape, incest, health to mother, or birth defects.

    The long answer is, this question has been asked every d**n time a Republican has run for office since 1973.  Let's see, we've had two Democrats and four Republicans in office since then, and nothing has happened to Roe v Wade yet.  This time will be no different.

  11. The president not congress has the authority to over turn a supreme court decision.   The best that can be done is to propose an amendment to the constitution which would trump the supreme court decision.

  12. The only way to do this is by taking the case to court.  It would ultimately have to end up at the Supreme Court where the final decision will be made.  I don't foresee any judges willing to overturn this decision.  It is to controversial.

  17. Why would you even ask that question?  What makes you think McCain would meddle in Supreme Court decisions.  Especially land mark ones like Roe v. Wade.  Is this some sort of joke that I didn't find funny?

  19. No. McCain is very liberal in terms of Conservative Republicans. Also the president can't overturn a supreme court ruling alone it would take a whole lot.

    I would love it if it were and people took responsibility of their own actions- this would be a much better country.  

  20. The president does not have the authority to overturn a supreme court decision. All McCain can do is nominate supreme court justices. If there are enough openings during his presidency and McCain nominates strictly pro-life judges, it could open the door for Roe vs Wade to be overturned.

    The reversal of Roe vs Wade wouldn't be entirely McCain's fault, it would also be the fault of Bush, and every other president who nominated a pro-life judge (who is still on the bench), AND it would be the fault of every american who voted for those pro-life presidents. In other words, its not McCain who has the power to overturn RvW, its the American people, based on who they elect as president.

    Next, you misunderstand what will happen if it is overturned. Abortion will not become immediately illegal. It will become an issue that each state can determine within their own state legislature. Some states will quickly ban abortion, others will never ban it.

  22. No, he won't because the case is already resolved and is a judicial matter, not an executive branch decision. Future decisions may set legal precedence, but until that point, or new legislation created by the legislative branch, Congress. The ideas allowed in that case will act as precedence and this issue will still be debated on all levels. The president alone does not have such power.

First of all, as president, he is really not in a position of overturn a Supreme Court ruling, even one as ridiculous as the one you mention.  And secondly, I really don't think he cares much about the deaths of unborn babies.  He doesn't seem too concerned about our MIAs.  He has always wanted to stop in Senate investigation into their fate.

    What can be done, is to start impeaching Supreme Court Justices for their failure to rule in accordance with the Constitution.  Contrary to popular belief, the justices do not serve lifetime appointments.  They serve for a period of "good behavior".  Misinterpreting the Constitution is what is meant by bad behavior.

    The impeachment would be done by the Congress, so the American people would have to replace a lot of our Representatives and Senators if they wish to purge the Court.  After forty years of propaganda, millions of Americans actually think abortion is a good thing.  This just goes to show how far down we have slid.

    Abortion really is a form of genocide.

    He might try to overturn it by appointing more conservative supreme court justices, however I think it would be detrimental to this country and there would be an uproar from hundreds of thousands of americans.

    it makes me sick to think that he would try and even attempt to overturn it.....if he has the cajones to do it, then he should be kicked in the cajones

    The problem with overturning a law or decision is that, whether you agree with it or not, once something is okay to do legally, once you make it illegal you create a black market.  People will still get their abortions, they'll just have them done by people who aren't doctors, or they'll go to countries where it is legal, but things aren't as "clean."
