If Social Security is my only income can it be garnished by a small claims court for credit card debt?

  2. Social Security payments are exempt from collection of consumer debt.

    However, once you deposit your money into a bank account, the account can be levied.

    Keep one account for your SS payments. Do not mix funds. Inform the bank that the money in that bank is protected. There is a form that you need  to fill out. The bank should be able to give that form.

    Also, if you own a home or other assets, your creditor can put liens against your property.

    Check the laws in your state to see what property is exempt from creditors.

    The only agency's that can garnish S.S.I. is the I.R.S. and S.S.I.
