If Someone Enters The USA Legally, But Overstays Does That Make them An Illegal Immigrant Anyways?

  2. Pretty much. Once they lose legal status (ie, their visa expires) they become 'illegal'.

    Even if they have a SS#, they are still illegal. If they get found out (which doesn't usually happen until you do something first, like try to apply for adjustment of status or another visa) then they will deported and have a ban on reentry imposed on them.

  5. Yup BUT they have a better chance of adjusting their status if they have the inclination.

    NOTE: There's a period they can adjust status in, if they overstay past that period they get treated as any other illegal.

  7. Yes, either enter illegally or enter legally but out of status, both are illegal aliens.  

  8. Yeah it does. If they get caught the are deported. If they end up leaving and this Immigration authorities notice that they overstayed, then they are not allowed back in the country, evn if on a three month waiver pgm (like for normal holidays) for a period of a specific number of years I do no remember but I think is 2 or 5.

  9. Yes, it does make them illegal.  They need to leave when they are supposed to leave, otherwise they are no better than any other criminal illegal alien invader.
