If You marry an american citizen do they have to be employed in order for the paper to be filed. My friend is getting married and she does not have a green card, her boy friend is a US citizen, but he is not employed right now ! Is it possible for him to help her without a job ? She has an off the books job, but as soon as she gets her work permit she will and is willing to work. How does it work?

  2. Without a job you cannot sponsor someone to come to the United States or in this case stay. Correction- if you have income without a job you can but most people have to have a job to have an income.  FYI she will not get a work permit until she completes the process which will take several years and entail her going back to her home country and getting a waiver for being here illegally. If she overstayed a visa then she doesn't have to return to her country. She can process a waiver here but only if her sponsoring relative can document ability to support her.

  3. You can always apply, they can not denied the application because it is your spouse.  What he can do is obtain evidence that a family member is going to help him economically.  You can file an affidavit of support, I-134, from a family member.  You can obtain a copy of this form at:

    for your case you can take look about the forms i-130 and I-864 plus I-485  .  The Groom will need a joint-sponsor to sponsor the Alien.

Actually, if the boyfriend can find a close friend or relative to file an affidavit of support as well to serve as a joint sponsor, then it is still possible for her immigrant status to be approved. As the petitioner,the boyfriend would still need to file an affidavit of support, even if he has no income, for the joint sponsor's income to be considered.
