  1. That depends, entirely, on the severity and circumstances of the assault. The military will, generally, allow you the time to attend civilian court. Depending on the sentence handed down from that, you may get back to the military, in which case a military tribunal will give you another slap, generally under the heading of 'bringing the service into disrepute.' This catches everything, believe me.

    If you are given a custodial sentence, you can forget a military career because pretty much every single time your unit will back up custodial with a swift dishonourable discharge when you get out of prison.

If the assault took place whilst on leave then it is purely a civilian matter, and as rightly said by others the military will be obliged to allow you to attend court.  When attending court you wil be accompanied by an Officer, who on the advise of a barristor may take your MOD 90 off of you, this is encase you are convicted and imprisoned ie bye bye military career.  If you recieve any other punishment the Civilian court will send the details to your unit who will begin a process known as Administrative Action against you.  This can range from a stern talking to right up to loss of rank and discharge from the army.  It willl all depend on a no. of factors and it is far to indepth to go into here, but you are entitled to advise from an Officer of your own choice to guide you through this.  Other factors will also be taking into account such as man hours spent dealing with the case and your conduct sheet ie is it clean or do you regulary fight.  It is highly unlikely you will be made to leave the Army as at the end of the day we are fighting men and every one makes mistakes.  But you will get into trouble, so be a man, stand up and admit you were wrong, dont what ever you do fight the system.

    the court case would be deferred, and they'll deal with you in the Army, and trust me, fromt he sounds of it, their punishments are not nice!

  4. Depends on the circumstances of the assault. But that matter would be dealt with by the civilian Police. The soldier would be questioned about the matter if he was allowed to return to barracks, but if he was guilty, he would be tried by a Military court and if the matter was serious enough, he would be sent to a military prison and after serving his time be dishonourably discharged from the service.

  5. It would depend on the severity of the assault and the resulting sentence handed down by the court.  If the sentence was one of imprisonment then they would be discharged under a section of AGAI`s.

If it was serious enough for his to be court martialled then he could end up being sent to a Military prison which would potentially mean he would keep his job, but if the CM decided that he should go to a civilian prison he would be automatically discharged.
