If a Costa Rican child were born to two Costa Rican citizens who were not married, would the birth certificate list the fathers name? In the case the father had no knowledge of the child, would the mother be able to still list him on the certificate or no? Thanks!

  1. The mother would be able to use the father's name, even if the father has no knowledge.  It will then be up to the father to contest the paternity when the child is born.

    Nº 8101

LA ASAMBLEA LEGISLATIVA DE LA REPÚBLICA DE COSTA RICA

    DECRETA:  LEY DE PATERNIDAD RESPONSABLE

That's the law, but it's in Spanish.  If you can read Spanish, I have provided the source where you can go to read the text.

For more information about Costa Rica, you can always go to www.ticosland.com.

  2. Short answer:  No.   But if a woman goes to the Civil Registry (Registro Civil) to register the birth of a child, she can tell the officers the name of the alleged father.  However, if she goes by herself and not accompanied by the father of the child, her last name(s) will be listed on the birth certificate.  If both of the parents go to the Civil Registry, and the father acknowledges his paternity, then both the father's and mother's name will be listed on the birth certificate (according to Latin American usage).

After the mother states the name of the alleged father, he will have to have a DNA test.

  3. Yes, I believe that is correct. It's her choice....

  4. a

  5. she can. but only if he accept it. if not, they will have a law process with adn test, in order to determinate if he is or is not the father. if not, the child will have mother's first and second last name

  6. Yes, I think there is a law about men owning up to their kids. The goverment protects Costa Rican woman, all men have to pay pension, for instance if you dont pay, you wont even be able to fly out of Costa Rica. Regardless if you are married or not. If you not sure it is your child, make sure you have a blood test so you know the child is yours. As alot of people have children to receive some sort of financial support.
