Considering that NASCAR currently has no clear cut drug testing policy they more than likely will let the driver retain his/her win with some kind of monetary fine and possible points deduction.  They may go as far and suspend the driver for a race or two after the fact but so far recent memory serves to suggest to me that no one on the Winston/Nextel/Sprint Cup level has had a win taken away for ANY reason.

However NASCAR took a win away this April from a driver in the Camping World East Series for having an illegal shock absorber on the car.

it's like this King Shoe Be Do, it depends on what kind of dope the driver is taking. You could ingest caffeine throughout the race. And there are many other legal substances that would be performance enhancers. I don't think anyone is offended by legal substances like caffeine. There are a few others, but i'm not going to influence the public on this one.
