Question:

If a Policeman has written a registration number wrong on a penalty notice is it invalid?

My partner was given a £60 fine & 3 penalty points for talking on his mobile phone whilst driving. He was actually pulling over when the police stopped him but he was still given the fine etc & told to produce his licence at his nearest police station. He went to the station to produce it but realised the officer had written his car registration wrong on the ticket. Everything else on the ticket, i.e. his name, D.O.B & address is correct. Is he able to contest this ticket because of this mistake? I'd really appreciate any advice from any solicitors on this matter. Thanks!

  1. Its worth making the argument, the worst they can do is make you pay the fine.

  2. Don't know much about English law , but it seems only a technicality & over here they'd make you pay it anyway - it's hard to beat a whole system.

  3. The driver got the penalty notice, not the car. They will amend the ticket to correct the error, but he will still be responsible.

As for the officer getting admonished for making a mistake, I suppose it could happen if he made enough of them.

  4. You people just try to get out of everything. If you or whoever go the ticket then you have to pay it.
