According to many former prisoners released due to DNA evidence, false testimony by Police and Criminal witnesses who bargained in their exchange for testimony this Practice is rampant. Things like this don't happen to people with good lawyers who have time to review cases. Do we simply not care or do we punish the poor?

  1. The prosecutor isn't the one that actually puts them in prison.  What about the juries in these cases, the ones that find them guilty?  The few crooked officers there are should be locked up for that.  But the prosecutor may not know they are lying, until years later.

  2. There is currently no law that punishes prosecutors for putting someone he knows to be behind bars. The law SAYS they have to dismiss the charges, but there is no punishment.

False testimony results in perjury which is a misdemeanor which results in a 24 hour jail sentence. Ultimately, when you prosecute an innocent man and he sits in prison for years, it's not so much criminal as it is civil in violating someone's rights. These prisoners are compensated the millions, USUALLY.
