If a check has 2 names on and it doesn't specify and but also doesn't specify or do both people have to sign.

What happen is the insurance company made out a check to my MIL and my husband. My MIL with out my knowledge deposited the check into her acct. This money was supposed to go back to the escrow acct. What recourse do I have with the bank that cashed it.

  1. Honestly, there isn't much fault to the bank.  You need to take it up with the MIL and possibly get a lawyer.  If the check is made payable to more than one name, either can cash the check.  I work for a bank.


  2. ~~If the line read your husband and mil then the bank needed both endorsements to deposit the check. If it said your husband or mil then what they did was okay. If it is "And" dispute it with her bank and they can charge her back.~~Actually, the insurance company should have made the check to the mortgage company so it could have been applied to the escrow account. However, you do have recourse if it is "and"~~
