If a company name is being used in the US can I used it in the UK?

It is a similar company but I can't find any trademark registrations for it. Even if I register it in the UK do they still have rights over the name?

Also this company is "company name couture," whereas I want to be "company name designs"

They have a website but it hasn't been updated since 2005.

Any advice?

If there is no trademark registration , you can. But, you might have retaliation.
