  1. Yes.  I may issue a citation based upon information that you committed the summary violation.  That information may come from my personal observation, a witness, another officer, investigation, or speed timing equipment (including radar.)

  2. If the second cop never stepped out of the vehicle how could he have identified you? I assume you has your seatbelt on and your insurance card and didn't admit to the first officer either offense.

I would go contest the ticket and explain that  to the judge if your innocent.  If the officer isn't present you may just get off.

  3. Well yes either one can give your a ticket but sometimes they decide if they should give you a ticket which they will eventually but its like deciding who should get what amount.

  4. Yep, this sure can happen. Sounds a bit fishy on their behalf, but yes they can.

You poor thing, what ever happened to the good old days where they just say "come on mate, this is a warning", and whatever happened to them going and catching REAL CRIMMINALS???

  5. Of course. If the police officer spots a crime or violation while he/she is present, then they can take appropriate action.

  6. i dont think so. it should already be taken care of

  7. Of course, a police officer can issue a ticket for any violation that he or she observes.

However, if you show the 2nd arresting officer the ticket you just received and explain that you are just taking the vehicle home, then he/she may not write the 2nd ticket.

In any case, you can always challenge the 2nd ticket in court.  If they are both for the same violation, you will likely only have to pay the first.

  8. Yes.

Could be the first officer stopped you, as the second officer had seen you in violation of the seat belt laws, radioed for assistance to other car in area?

After stop, second officer arrived, as you were stopped for him by First officer.

Second officer was original sighting and first officer made stop, since second officer had to turn around to get back to you?

  9. Yep. First cop is a witness or arresting officer. Second cop could be training or first cop is out of tickets.

  10. Any police officer can write a ticket regardless if they are first on the scene or 5th.....

  11. No seat belt: No, he didn't witness it.

As for not having insurance... you are up the creek without the proverbial paddle there.
