If a family applies for Canadian permanent residence...?

If a family of four applies for Canadian permanent residence, and they are all granted the status, and one of them does not meet their residency obligation, do all the family members lose their PR status? What if the one person that doesn't meet their residency obligation was the primary applicant? Thanks.

  1. when you say lose their residency status - do you mean they stayed out of Canada too long? (longer than 3 years?)

    I would say that ONLY the person who stayed away too long loses their residency status. The rest of the family are ok and can stay in Canada.

    The person who lost the PR status, MUST reapply for PR, and do everything all over again. Either the parents can reapply for them as long as the child is still under the age of 22. Or the legal spouse can reapply for for the other spouse. Or if the child is now over 22, then they must reapply as a skilled worker and  go through the entire process again.

    The only situation I am aware of is where the family can be denied as a family - is where the family applying for PR has one family member with a major medical problem [developmental or intellectually handicap]. That is when the entire family can be denied. becasue that one person will "be a drain on the health system"


  2. If they were all granted status but the one they ae all eligible to come over. The person not granted the residency can appeal the decision.
