If a father refuses to sign a birth certificate does he have any legal rights to the baby?

the father of my baby has refused to sign the birth certificate, n has refused to go a DNA test, he was a intervention against him, both myself n my baby stated on it, with all this, would he any legal rights (claims) to my baby

Of course he has rights - he's the father, whether he signed the birth certificate or not.  The court can order a DNA test, and if he refuses he will probably be named the father by default.  Get to court and file for full custody - if he doesn't show up in court, the judge will probably grant in your favor.


  2. a birth certificate has no legal significance.  If he thinks he is the father he can apply to the court for custody or visitation or anything else.  Before considering that application, the court will order a DNA test for parentage. If he is the father, the court will enter its orders by considering the best interests of the child.   Similarly, if you apply to the court for an order requiring him to pay child support, the court will first order a DNA test and if he is the father the court will order child support.  I don't know that the phrase "he was an intervention against him" means.  In fact, I don't know what most of your question means, but I hope this has answered it.  

  3. If the matter is or will going to go through court you might not even need a DNA test. My friend went through a simular situation and the father refused to go for a DNA based.

    Based on this the courts found him legally to be the father! His name isnt on the birth certificate but she has a piece of paper from the courts stating he is the father.

    Does he even want contact etc??

    but my sisters(twins)

    were born and their father wld not sign the bc

    so a friend of my moms signed it

    he had every right then to claim the girls has his

    and the real father did not

    but the real father eventually took a dna test that proves he is the father, and NOW he has the rights has father and he alone had to pay child support

    though the other guy is still on the bc he has NO rights

    maybe from that u will get the answer cuz i cant really explain it

  6. If he is the proven legal father, yes, he does have rights to his child.  He also has the responsibility to support the child.

    If the father disputes the paternity, the mother can apply for a paternity test (DNA).  But at any time that paternity is proven, all the rights and responsibilities of the father become active.  Those include custody and/or visitation rights, as well as the financial responsibility for the child.

  8. I have four kids and never was asked to sign a birth certificate.

    My wife told the doctor or nurse what name we wanted, listed our names as mother and father and the doctor issued the certificate.

  10. You go in front of a judge and get a court order to have a DNA test done. At that point, unless the judge terminates his parental rights, then he has the same legal rights as any other parent. Until he is named the "legal father," he has no rights. So if his name is not on the birth certificate, there's no DNA to prove he's the father and no court order then he has no claim and no rights to the child.
