Question:

If a fathers name isn't on the childs birth certificate, does he have any rights?

My friends baby is almost a year old. The father hasn't wanted to see the baby or have anything to do with her since she was born. His name isn't on the birth certificate either. Does he have any "rights" that would have to be signed over still so that my friends husband could adopt the baby?

  2. legally no unless he gets a court ordered DNA test which would be hard because he has no proof that the kid is even associated with him. All your friend has to do is say tht she was sleeping with multiple guys around the time of conceptiona dn don't know their names.

As far as I know (I have researched this quite a bit being I am in the same situation) if he has not acknowledged paternity in any way (not on birth certificate, didn't sign it, no child support, nothing) then he has no rights.  I have not consulted an attorney however.  So your best bet would be to do that to make sure.

  5. He doesn't have any rights at the moment, but if he asks for a paternity test he can take her to court and have his rights established.

  6. Nope all they have to do is go to your states center where they hold the birth cert. and he says i am the father and want to me on my child birth cert. Generally they wont ask any ?s and just let him sign their name on it. As to the other father, no he has no rights unless he is on the cert.

  7. Having gone through this, if his name isn't on the birth cert, he technically cannot claim any rights. If the birth father wanted rights, he would need to prove he was the father. So I would say that the husband could adopt the child, just say you don't know who the father was or something along those lines (if possible).
