Question:

If a freeway doesn't have a traffic survey, does that mean a speeding case can be dismissed?

So I got a speeding ticket, and the posted maximum speed limit was 65. I've called CalTrans to get a road/traffic/speed/engineering survey for the freeway (Highway 99) but they inform me that there is no road survey for that particular stretch of highway. So does that justify the dismissal of a speeding case, or the creation of an illegal speed trap (if an officer uses a radar)?

  1. That does not justify the dismissal of a speeding case.  Speeding is incredibly simple; the sign tells you the highest speed you're allowed to go, and you obey.

    Rather than trying to find a technicality to justify your speeding, try honesty.  I'll be honest with YOU-- I've gotten out of 2 large speeding tickets (this was actually IN COURT, mind you, not just at the side of the road) by being honest and kind.  My first ticket was going 50 in a 30, after midnight while under 18.  I was honest in court that I was simply focussed on getting home and apologized for going over the speed limit.  I did not place the blame on the officer, even though I know I wasn't going nearly as fast as he said I was.  My car was having trouble-- it couldn't even go that fast.  I didn't say that though.

    Trust me, just appeal the ticket, enjoy the day off from work and state your case.  Apologize for going over the speed limit, and assure them it's not something you normally do.  If you have a good record behind you, boast that.  No speeding tickets in the past likely means no speeding tickets in the future.

  2. It is not a speed trap.  The speed limit was 65, and you were speeding.
