If a man signed a birth certificate,but then finds out he is not the dad,can he give up his rights as the dad?

  2. yes, just like going through a divorce. You can terminate your rights. However if this child grew up with a loving father who s/he believes is her/his dad and the father loves this child. Why terminate the right? Because s/he's not blood? Love is stronger than anything.

  4. If he is not the dad then what rights does he have.He needs to show proof he is not the dad then request for his name to be removed.But why bother so many kids these days need fathers and dads bail out,so be a father to the child,then again women abuse child support.

  5. Any father, biological or not, can give up his rights.  Rights include ability to make parenting decisions, visitation, etc.  Obligations, such as child support, are not the same as rights.

    If you meant obligations, it depends.  Most states give 60 days from the signing of the BC for a father to prove that he isn't the biological father and be removed as the legal father.  So if it's been longer than 2 months, the dad is most likely going to remain the legal dad regardless of what the paternity test says.  In other words, make sure you're the biological father before signing!

  6. Don't know the law, especially don't know New Jersey law.

    But I'd suspect that he could give up his rights and his responsibilities IF he could demonstrate to a judge or to a court of law that he had signed it under duress or because he had been told lies about his status.

    But if he hadn't been "fooling around" with the girl who also had other "friends" "fooling around" with her ... then wouldn't he have known that he could NOT have been the father, even if she told him he was?

  7. well i know that where i live here in california if a man sighns a birth certicate he is responsible for that child wether he is the father or not and actually has to go to court to prove he is not and to have his name removed! but until then he has to pay child support!
