If a military wife cheats on her husband, does he have to pay her until they are divorced?

I just want to add that she ended up pregnant by another man. So the proof is in the pudding about her cheating. He is paying her child support for theri child but is he still supposed to pay her BAH even though she moved out on her own free will?

  3. it doesn't matter who did wrong to who until one of them files for divorce and there is a court order for support (if there ends up being one).

    the active-duty member receives bah (extra $$ in his/her paycheck every month) based on whether or not he/she has any dependents.

    and yes, bah (or i should clarify, the AMOUNT OF) depends on whether or not there are dependents. there is single rate and with dependents rate. sheesh.

    each branch (except af) has fairly specific guidelines regarding support for dependents in the case of separation and in the absence of court orders. however, the military cannot force the active-duty member to pay that support.

    The only things he'll ever be obligated to pay is child support. Wife doesn't need anything, and shouldn't get anything. it's as simple as him changing his direct deposit to an account set up just for him.  

  5. Until a court of law or the Judge Advocate General tells him too, he doesnt have to pay a thing. In fact as a soldier myself, I would be changing a lot of things right off the bat, like my Life Insurance, you can guarantee you would not be the beneficiary. Yes, you are still considered a dependent until the final divorce, and you still have all of your ID privileges such as Commissary, PX and hospital. Again as stated earlier, it is adultery, and you will not get much out of the divorce. BAH is based off of where your legal residence is, not how many dependents.

  7. no its adultery in fact it is a crime in most states and if I'm not mistaken its pretty much a done deal there is no process she doesn't get any of his possessions its pretty much you sign a piece of paper and its done

I am retired AF, and certified in government law and miliatry law,   Nope, he is not required to pay her anything except child support, if the child is really his period.  If she needs money, she should just go stand on the corner and be the person she really is!!!  Seems like all she is interested in is s******g he military member again.  If she cheated with another military member, he can go and request charges be placed against that member, he can also, go to the base commander and have her access to the base be withdrawn based on her cheating ways based on her admitted adultry, while on any military installation wive's are subject to the Uniform Code of Military Justice, and adultry is a violation of such.  I hope he does do this, she's a low life and doesn't deserve any type of access to any honorable military installation and it's services.

    The answer - no matter how unpopular it is - is YES. By law, a service member is required to provide reasonable support to his spouse - even if she cheated, even if she left him, even if she's pregnant with someone else's baby. That amount is usually the amount of his BAH.

    Once he is divorced, the court will determine what - if anything - he has to pay, but as long as he is married and in the military, he is legally obligated to provide for his wife. Yes - even if she's a cheating dog.

    The amount he is paying in "child support" counts in the total amount - he doesn't have to pay child support PLUS his BAH.

    BTW-- adultery isn't illegal in most states. It's a social issue, not a legal issue. it's wrong, but it isn't against the law.

  11. until they are legally divorced the military will require the service member to at least pay the wife BAH since he is getting the BAH because of being married to her...once their divorce it depends on the civilian courts say if she's entitled to alimony..
