Parental kidnapping is the practice of a noncustodial parent taking a child from the custodial parent from one state to another without court permission or in violation of court orders obtained through a divorce or custody hearing. 2. Unless they have come to some type of agreement where the child can stay longer then techincally yes it is called kidnapping.  If they have a legal agreement that says she must return the child at, for example, eight pm on sunday, and she does not, the father can call the police and have her picked up.

    It;s called Parental Kidnapping.
