  2. Granny is right. Claim on your insurance company who will deal with neighbour's building insurance (if any).

  3. The owner of the property.

    Just because the tree grew on someone elses yard, does not make any damage that tree does, their responsibility.

    You have to rake up the leaves, when they fall in your yard.  You have to clean up the branches.

  4. I believe that you claim it on your insurance and your insurance subrogates against his insurance company to get their money back.

  5. Your neighbor or their insurance company are not automatically liable just because the tree is on the neighbor's property.

    In order for them to be liable they have to have some kind of negligence. If the tree was dead and you or the city told them to cut it down and they didn't do it, that would be negligence.

    If the tree is healthy and came down in a storm then the neighbor is not negligent or liable.

    Best thing to do is turn it in to your own insurance and let them investigate into whether the neighbor is negligent/liable.
