  1. It would be paid from the estate if there is anything left in it.  succession may need to be refused by the heirs, as they would be liable for debts as well as assets of the estate


  2. Yes.

  3. The estate is responsible to pay any tax due before making distributions.  If the Administrator fails to pay the tax and distributes all of the money he becomes responsible to pay those taxes.  Now on the other hand if the estate has no assets but would have owed taxes there is no one required to pay the back taxes.  For example my Uncle dies and I file his final year tax return which shows that he owed $2,000.  But he had no funds from which that could be paid.  I am not responsible to pay it.
