If a person has a lien on a car, can they legally sell it to someone else on monthly payments?

A man sold me a car last year....i made monthly payments of $300 dollars a month. i found out 6 months later he has a lien on it from GMAC.....was he legally allowed to sell it to me in the first place?

  1. You mean that GMAC has a lien on it?  Who were you paying?  If he paid down his debt with GMAC, then fine.  Otherwise, he will be in trouble for selling it.  You could be as well to the extent that GMAC takes the car away from you.


  2. No.  If someone has a lien on the car they cannot sell it to you - and the DMV should not have switched the title without proof of a lien paid off.  I'd say you better check into things.

  3. no he illegally took money from u knowing that he owed money on that car.u can take him to small claims court and get your money back.

  4. Well did u have a title from this man?I'd say NO its not legal..
