  1. I believe each state has its own laws and procedures for declaring someone legally dead when no body is found.  I think it is 7 years in most places.  It is not usually done except for the purpose of settling an estate.

  3. No. Adults go missing all the time by their own accord and for their own reasons. Most missing children in the country have parents who are divorced and the non-custodial parent decides to take the child away from the area of the custodial parent.

  4. The daughter of that Austrian sick guy went missing for 23 years or so...she was found alive, so the answer to your question is NO.
