If a pregnant lady murders someone and gets the guilty verdict..

And gets the death sentence,does the law wait until the baby is delivered before giving the sentence?

  1. When preparing for a capital case, where the prosecutor is seeking the death penalty, it takes a very long time to go to trial.  The child would be born prior to the trial.

    If somehow she was pregnant at the time of execution, no State would execute a death sentence on an unborn child.  The State would wait until after the birth of the child.

    Of note, there are very few women on death row.

  3. it takes years to be put to death.  once convicted and given the death sentence, you have an automatic appeal.  appeals take years before they are heard and decided.  after that, you can appeal to the supreme court.  By now, 8 to 10 years have gone by.

  4. Yes they would wait the 9 months. Even if she is pregnant from prison. The baby is not sentenced.

  5. Yeah. But idk, what if the pregnant lady tries to get pregnant again and again to avoid her death sentence? i mean poor babies

One would have to argue that if current law were to be observed, that her condition is of no more importance than having a kidney stone if indeed the death sentence were looming that quickly after a trial.  Any attempt to recognize any "special circumstance" concerning her pregnancy would have to be hard fought by pro-abortion advocates, lest intervening precedent lend validity to a right-to-life argument in favor of saving the child.

  7. She will probably have to deliver the baby and put in foster care or up for adoption and then serve her sentence.
