If a teacher begin teaching 5-2-05 is that teacher tenured 5-3-08 with a 2 month sick leave from 12-05-2-06.?

The teacher started teaching 5-2-05 and was non-renewed 5-9-08 is that teacher tenured. The same teacher took a two month sick leave from 12-7-05-2-6-06, can the district use the unpaid sick leave to say that teacher is not tenured? The teacher was still under contract and returned to the district from 2-6-05-5-9-08, completing the required time to become tenured. Now the teacher is not sure if she is tenured because of the time she took off when she was sick. Tenured or not?

The only way to accurately answer your question is to check your contract.  Different districts have different standards for establishing tenure, and there is no way to determine what your rights are in this situation by asking this question on Yahoo Answers.  Read your contract and contact your local teachers' association representative for assistance.  Your local association is probably affiliated with either the NEA or AFT, and you can get legal assistance from your local chapter.  Make contact with them NOW - time is of the essence!


  2. I guess for you, yes.  In my state you wouldn't be because ours is four years for tenure.  I don't think sick leave would factor into that though.
