  3. It is not "Hearsay", it is "Direct Testimony". Hearsay is when someone repeats an oral, written, or other statement made by a second party (or even themselves in some cases) during trial. There are several factors used to determine if something is hearsay and there are ~30 current exeptions to the rule. Direct testimony is where the witness testifies about something they directly saw, heard, felt, etc.

    "I saw a blue truck driving away from the accident." is direct testimony since the witenss saw the truck themselves.

    "Bob said that he saw a blue truck driving away from the accident." is hearsay since the witness did not see the truck themselves.

    In the senario above the witness personaly heard the gunshots, so it is considered direct testimony.

  4. well if your on the stand your need for some reason because u wouldn't be on the stand if it was hear say. i believe your needed for many reason's
