Question:

If a woman's father abuses his children including her is he still her first wali?

Please only answer in regards to the question if you are a knowledgeable Muslim. I know all the other stuff people are going to say, but what I am looking for is only answerable by a Muslim with good knowledge. It has to do with something you do not know about if you are a non-Muslim and while I appreciate the "call 911"'s, the "you should kick his ***"'s, and the "that's just sick"'s they do nothing to answer the question. I am looking to marry this girl and I need that question answered for it to be a valid Muslim contract. Do not get me wrong I care about her greatly, but if you really want to help only answer the question asked.

He used to beat her, he backbites falsely about zinna having to do with her, he hired a spy to keep her inside the house, he made fun of her for being suicidal, he won't let her have friends, and he won't let her receive proper medical treatment it wasn't life threatening but it was temporarily crippling, and he refuses her exercise outside (which was actually prescribed by the doctor when he finally gave in after a month).

Furthermore, I do not want long essays about how you don't need a wali. I want to know if he is still her wali that is all.

  1. I am not expert, but from what I have seen in some Muslim countries, the answer is no. If he is abusing her, then he may not keep this position. Islam is not supposed to make life more difficult.
