  1. If the police were called at the time of the incident and did not make an arrest...you would need to file the warrant of arrest as the offense was a misdemeanor not observed in the presence of the officer.

    If the level of injuries were severe enough to warrant a felony charge of assault/domestic violence...then the police, after gathering all the evidence available, can get the warrant signed themselves.

    It would appear to me, however, the assault was less severe and only a misdemeanor where the police should have told you to get the warrant of arrest against the offender.


  2. yes they can do that if they wish to persue that person depending on what they did for a crime
