So apparently, It takes 3 months for the Canadian sponsor's application to be reviewed and approved... and 6 - 9 months for the person you are sponsoring to get reviewed and approved...

If after I (the sponsor) am found eligible to sponsor my husband, while his application is being reviewed, can i claim bankruptcy?

Any info would be great

  1. if you are sponsoring your husband you are responsible or him in all ways for 3-10years

he can not claim any government financial help,by law you must report any change of conditions to immigration while the case is being reviewed and bankruptcy is a big change of condition. not to do so is an offense

if you cant show enough income to support him the visa may be denied

  2. This is too risky...I understand that you are going to wait until after you are approved but I would not move forward with the bankruptcy until you have the PR card in hand.  Too many things can happen while your file is still open.  The government can reserve the right to go back over your file at any time during the processing.

I pasted this statement from the CIC website::

Note: Misrepresenting your situation in any way can make you inadmissible to Canada. You cannot misrepresent any relevant facts in your application. You cannot misrepresent your family members and marital status, and you must inform Citizenship and Immigration Canada of any change in circumstances. You must identify all your family members in the application. If you fail to disclose and/or have examined any of your close family members at any time between the date of the original application and the date your family member is granted permanent residence, you will be barred from sponsoring those members in the future.

Legally, if anything changes on your application during the time of processing you are obligated to inform them.  Since the question about bankruptcy is clearly stated on the Eligibility Evaluation it would be your legal obligation to tell them.

Just wait until PR is granted----then do as you wish.

  3. I wouldn't recommend filing for bankruptcy.  Your application as a sponsor will probably not be approved if you can't show that you will be able to  financially support your husband.  Because anyone who files for bankruptcy is ineligble to apply to sponsor someone.  Even if you become initally approved to be a sponsor and then immigration sees you went and filed for bankruptcy shortly after, they may deny your husband a PR visa.
